Text Messaging Terms

1. Acceptance of Terms

By providing your mobile phone number to A-dec, Inc. ("A-dec," "we," "us," or "our") and requesting to receive text messages, you agree to these Text Messaging Terms ("Terms").

2. Enrollment and Consent

By providing your mobile number during a customer service interaction and requesting text messages, you expressly consent to receive text messages from us using automated technology. Your consent authorizes us to send messages related to customer service inquiries and responses. A purchase is not required to receive text messages.

3. Message Frequency and Content

Message frequency varies based on your interactions with our customer service team and your account activity. Messages may include information about your account, orders, appointments, and responses to your inquiries.

4. Costs and Carriers

Message and data rates may apply to each text message sent or received in connection with our text messaging program, according to your wireless service agreement with your carrier. Our text messaging program is supported by most major carriers, including AT&T, T-Mobile, Verizon, Sprint, and others. However, we do not guarantee availability on all wireless carriers or devices.

5. Opt-Out Procedures

You may opt out of our text messaging program at any time by replying "STOP" to any message you receive from us. After you opt out, we may send you one final message confirming your opt-out status. If you opt out and later wish to rejoin, you can do so by contacting our customer service team.

6. Privacy

We collect and use your mobile number and message content in accordance with our Privacy Notice. We may share your mobile number with service providers who assist us in delivering text messages. We will not sell or share your mobile number with third parties for their own marketing purposes.

7. Service Availability and Delivery

We do not guarantee delivery of text messages and are not responsible for any delays or failures in the receipt of messages. Various factors may impact message delivery, including carrier network issues, your device settings, or your location.

8. Termination

We reserve the right to suspend or terminate your participation in our text messaging program at any time, with or without notice.

9. LIMITATIONS OF LIABILITY

WE ARE NOT LIABLE FOR ANY SERVICE INTERRUPTIONS OR DELAYS IN MESSAGE DELIVERY. TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, IN NO EVENT WILL A-DEC BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES (INCLUDING DAMAGES FOR INCREASED COSTS, DIMINUTION IN VALUE OR LOST BUSINESS, PRODUCTION, LOST DATA, REVENUES, OR PROFITS, GOODWILL, REPUTATION, OR ANY OTHER INTANGIBLE LOSS) ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE THE PROGRAM, MATERIALS, OR PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT A-DEC HAS BEEN INFORMED OF THE POSSIBILITY OF DAMAGE. THE AGGREGATE LIABILITY OF A-DEC ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OR ANY INABILITY TO USE ANY PORTION OF THE PROGRAM OR PRODUCTS USED IN CONJUNCTION WITH THE PROGRAM OR OTHERWISE UNDER THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, WILL NOT EXCEED USD $100.

10. Governing Law and Venue

These Terms, your use of the program, and any disputes arising out of or in connection with such will be governed by the laws of the State of Oregon, without regard to conflict of laws principles. The courts located in Multnomah County, Oregon will have exclusive jurisdiction over any disputes arising out of these Terms, and you agree to such personal jurisdiction and venue. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY ACTION YOU MAY HAVE RELATING TO OR ARISING OUT OF THESE TERMS OR THE PROGRAM WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via text message or other means. Your continued use of our text messaging program after such modifications constitutes your acceptance of the updated Terms.
